Evictions




An eviction application becomes necessary if the lease agreement between owner and tenant has come to an end either in terms of the agreement or due to notice of cancellation.

If the tenant does not vacate the premises the owner will have to proceed with an eviction application.

This is also the case when a person occupies premises without a lease agreement.

This procedure is regulated by the PIE Act (Prevention of Illegal Evictions from and Unlawful Occupations Act 90 of 1998) with the result that it can be a complicated process for an owner to reclaim occupation of his property.
